The domain name multiFlats.com (hereinafter referred to as "Website") is owned by multiFlats Realty Services Pvt Ltd, registered under the Company's Act,1956 (hereinafter referred to as "Company" or "multiFlats" having registered office at Faridabad (Haryana), India.

Definition:-

We are an Online Marketplace / Marketing and e-Advertising Platform connecting people in the real estate market. multiFlats.com provide you with access to a variety of services, including but not limited to the www.multiFlats.com website (the "Website") and mobile applications and all the products and services available through our website (collectively the "Services").

The term 'authorized user' would include any person, whether an individual or a legal entity who has subscribed to the services of multiFlats.com and to whom the access is restricted by the use of a sign in user name and a password. The user name and password are either allotted by multiFlats.com or chosen by the user or agreed upon by multiFlats.com. It is made abundantly clear that only the authorised user has the right to access the services so offered by multiFlats.com.

For the purposes of this agreement, any person who does not have a legal or a contractual right to access the services, but does so, will fall within the definition of an 'unauthorised user' and will be subject to the terms and conditions, and expressly so with respect to respecting the intellectual property rights of the provider, and abiding by licensing terms and conditions.

The terms 'User' and 'customer' would include both the authorised and unauthorised user(s)

The terms 'service' or 'services' would mean to include the interactive online information service offered by multiFlats.com on the internet through which the user may access information carried by multiFlats.com in the database maintained by it. The terms would include to mean the search tools through which the user can search through the hosted databases and information using a number of search tools that are present with a selection matching their search criteria. Users then select one or more of the items presented to view the full document/ record. The term service does not extend to multiFlats.com acting as an agent either express or implied on behalf of any user/customer

This Contract is effective from the date when you first start using multiFlats.com and/or first start registration on multiFlats.com and the same shall continue until terminated by either party expressly by giving written notice. multiFlats.com provides advertising services relating to real estate/property and other connected services without any specific warranty of any specific result/outcome.

multiFlats.com may modify this Agreement from time to time at its own discretion. Any alteration in this Contract term shall be effective on sending an alert email to that effect to your email address as provided by you from time to time. You are supposed to check the provisions of this Contract regularly to update yourself accordingly. Your use of multiFlats.com site implies your acceptance of change in this Contract as effected by multiFlats.com from time to time.

You are allowed to use our Services only if you can form a binding contract with us, and only in compliance with our Terms of Use and all applicable laws. The following terms and conditions apply to everyone who uses multiFlats.com Services (including real estate professionals and developers), and they govern the relationship between multiFlats.com and our users during their use of Services.

Acceptance to term of use:-

The use of this Website by You is solely governed by these Terms of Use ("Terms" or "Terms of Use") and any policy/terms so mentioned by terms of reference. Browsing the Website or use of the services offered through the Website shall be taken to mean that You have read and agreed to Terms of Use so binding in You and that You are contracting with multiFlats.com and have undertaken binding obligations with multiFlats.com. By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Privacy Policy available at /privacy-policy, which may be amended from time to time.

You will be subject to the rules, guidelines, policies, terms, and conditions applicable to any service that is provided by this Website, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part of Terms of Use.

Amendment/Modification of Terms/Services:-

multiFlats.com holds the sole right to modify the Terms of Use without prior permission from You or informing You. The relationship creates on You, a duty to periodically check these Terms and stay updated on its requirements. If you continue to browse/use the Website following such a change, this is deemed as consent by you to the so amended policies.

multiFlats.com, reserves its right to withdraw wholly or partly, without assigning any reason, any of Services offered through the Website with or without any notice.

Submission and Administration of Listings:-

Any customer agrees not to submit any property descriptions, photographs, financial, contact or other information contained in each Property's data to multiFlats.com unless the Customer has acquired received all necessary rights and authorizations from the owner of such property or the power-of-attorney holder, including from the photographer and/or copyright owner of any photographs, to publish and advertise the said Property(s) on the Customer's website or on multiFlats. The customer shall disclose all material information in respect of all such property(s) submitted including the present status and nature of such property and shall also disclose whether the property is free from all encumbrances or not. The customer in addition shall furnish a brief background of such property in respect of title, ownership and possession, multiFlats.com may also require the customer to support his/her claims with respect to the status of the property with such documents as may be specified by it from time to time. The Customer may further be required to substantiate his claims as to the nature and status of the property by swearing an affidavit stating the authenticity of the information/data so provided/displayed. multiFlats.com may, at its sole discretion but without any obligation to, search for such and remove properties that are alleged to have been submitted in violation of this provision. In addition, multiFlats.com may require additional evidence of compliance with this provision from Customers who are alleged to have submitted Properties or other information/data in violation of this Agreement. multiFlats.com will, in its sole discretion, terminate the accounts of, and refuse service to, any Customer who repeatedly or intentionally violates this Agreement. Additionally, the Customer agrees to allow the Property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by users of the Customer's website or the multiFlats.com website. multiFlats.com shall have the sole authority to choose the manner in which any Property will be searched, displayed, accessed, downloaded, copied, and otherwise used on multiFlats.com shall have the right to modify the property listing in the exercise of its rights under this Agreement. In addition to the terms aforementioned the customer agrees

(a) to represent and warrant that all Properties and associated information provided by the Customer will be accurate; (b) that the Customer will not permit the posting of a property on multiFlats.com under a name other than the name of a real estate agent who has been duly authorized and engaged by the owner of the property in this regard;

multiFlats.com reserves, in a manner consistent with reasonable commercial business practices, the right to remove all or any part of the Properties posted on the Customer's website or on multiFlats.com without notice. multiFlats.com accepts no responsibility for checking/verifying the accuracy of reports or data files submitted by the Customer. While multiFlats.com shall efforts for data backup and business resumption, the Customer will be solely responsible for retaining back-up copies of all information, photographs and other materials furnished/submitted to multiFlats.com

Customers, who are buying/renting property/properties through multiFlats.com, must verify details the property/properties as well as its right, title, ownership, lien etc. on their own.

Subscription fee:-

The applicable rate of the Subscription Fees for the Service provided shall be such as mentioned in website Subscriptions page or as may be prescribed by the Company from time to time

Liability for the Subscription Fees shall accrue from the Date of Commencement.

All individual Users who access or make postings of information at multiFlats.com for the purpose of buying property shall be exempted from the application of this clause.

Payment:-

Where Subscription Fees accrues it shall be payable at or within such time as stated in the invoice(s) issued by the Company to the User.

The Subscription Fees shall be paid by the User on demand. In case the user disputes the same for any reason whatsoever, he shall make the payment towards the Subscription Fees accrued subject to the decision of the Company on the dispute. In the event of Company’s deciding the dispute in the User’s favour, the Company shall refund to the User any excess amount paid by the User free of interest.

Any delay in the payment by the User of any sums due under this Agreement, the Company shall have the right to charge interest on the outstanding amount from the date the payment became due until the date of final payment by the User.

multiFlats.com shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the user's account and / or information relating to or regarding online transactions using credit cards / debit cards and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise.

Cancellation/Refund Policy:-

multiFlats.com shall reserve the exclusive right to cancel any content whatsoever from being published or reflected on its website or in any other mode. The cancellation charges payable to the User shall be at the applicable rates laid down in the cancellation and refund policy.

While availing any of the payment method/s available on the Website, multiFlats.com will not be responsible or assume any liability whatsoever in respect of any loss or damage arising directly or indirectly to you. All payments made on the Website, including payments made toward apartment bookings, are non-refundable. In the event payment is deducted from the User's account with non-completion of the booking, the exact amount shall be refunded to the User via the same mode of payment within 3-5 working days. All commercial terms are on a principal-to-principal basis between the Buyer and the Seller and multiFlats.com payment facility is merely used by the Buyer and the Seller to facilitate the completion of the transaction. Use of the payment facility shall not render multiFlats.com liable or responsible for the non- completion, non-payment, damage, breach of representations and warranties or fraud as regards the projects listed on multiFlats.com Website.

Obligation of User/Subscriber/Guest:-

The accuracy of the Registration Data given to the Company on initial application for the Service shall be the sole responsibility of the User.

The user agrees that any data entered into herein will be subject to mandatory verification process by multiFlats.com Private Limited.

Any licenses, permits, consents, approvals and intellectual property or other rights as may be required for using the Service shall be obtained by the User at his own cost.

The User will ensure compliance with all notices or instructions given by the Company from time to time to enable the use of the Service.

The User understands and agrees that User is responsible for all applicable taxes and for all costs that are incurred in using the multiFlats.com service.

The User shall be solely responsible for all information retrieved, stored and transmitted through the Service by him.

The User shall keep confidential and not disclose to any person the User's password and user identification and all activities and transmission performed by the User through his user identification.

The User shall immediately notify the Company of any un-authorized use of the User's account or any other breach of security known to the User.

The User shall promptly make the payment to the Company towards the Subscription Fees as and when it becomes payable.

The User shall be responsible for the set-up or configuration of his equipment for access to the Service.

multiFlats.com in its sole discretion shall reserve the right to edit, modify and alter the content. User agrees that the online advertisements placed with multiFlats.com shall be reflected after 48 hours. The user further agrees to the stipulated 48 hours processing.

The User will indemnify multiFlats Pvt Ltd for any action or claim committed/made by any third party resulting from any information posted on the site by the user or/and anybody else on his behalf.

"multiFlats.com do not accept any responsibility towards the data entered in our website. The user who has entered the data is fully responsible for any wrong data entered and be liable for any and all action taken by third party (whether civil/criminal). multiFlats.com however shall Endeavour to use the best industry practice of weeding out all wrong data/ false data entered and undertakes to withdraw all such data within 24 hours of receipt of such complaint. All complaint should be addresses by email at grievance@multiFlats.com

"The user agrees that any data entered into herein can and shall be saved, used and commercially exploited by multiFlats.com as deemed fit by them".

"User of the website agrees to indemnify and keep multiFlats.com indemnified from any wrong/false data entered into and hereby warrants and covenants that all data entered into the website is true and correct and belongs exclusively to him and not to any other third party"

All rights accruing from the same, statutory or otherwise wholly vest with multiFlats.com. multiFlats.com respects the Intellectual Property Rights of all; it has and will continue to adhere to all the laws applicable in India in this respect. multiFlats.com shall respect the Intellectual Property Rights of the users as well as third parties. In a case where a User/s are found to be using Website as a platform to infringe the Intellectual Property Rights of others, Multifltas.com will be free to terminate the said User/s account forthwith without any notice to the user

Termination:-

multiFlats.com may, without notice in its sole discretion, and at any time, terminate or restrict your use or access to multiFlats.com (or any part thereof) for any reason, including, without limitation, that multiFlats.com based on its judgement and perception believes you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions.

Dispute Resolution/Arbitration:-

Unless you have entered into an additional agreement with multiFlats.com that provides for an alternative dispute resolution mechanism, you agree that any dispute arising between you and multiFlats.com which cannot be resolved amicably shall be conclusively resolved by a sole arbitrator. The Arbitration shall be conducted as per the Arbitration rules laid down under the Arbitration and Conciliation Act, 1996, and any modification/amendment effected thereafter from time to time. The arbitration shall be conducted in the English language and the award passed by the Arbitrator shall be final and binding on both parties. The cost of arbitration shall be borne by you, unless awarded otherwise.

Indemnification:-

You agree to indemnify and hold multiFlats.com, its directors, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the multiFlats.com Services in violation of this Agreement and/or arising from a breach of any of the terms of this Agreement and/or any breach of your representations and warranties set forth above

Governing Law: -

By accessing the Website you agree that the laws prevailing in India shall be the governing laws in all matters relating to these Terms.

Jurisdiction: -

Courts at Faridabad, India alone shall have the exclusive jurisdiction in all matters relating to the use of these Terms, irrespective of the territory and jurisdiction of your access to the Website. You agree to inform us if you come across any listing or posting that is offensive or violates our listing policy or infringes any intellectual property rights by sending a mail to grievance@multiFlats.com to enable us to keep the Website working efficiently and in a safe manner. We reserve the right to take down any posting, listing or information and or limit or terminate our Services and further take all reasonable technical and legal steps to prevent the misuse of the Website in keeping with the letter and spirit of these Terms.

The information provided in this Website is based on multiFlats.com data which is collected from various publicly known sources viz, websites, documents and maps including multiFlats.com proprietary data resources, and from the inputs of unidentified individuals. It ought to be considered as a guideline and not as absolutely certain. While care has been taken for groundwork, no responsibility is accepted for the accuracy of whole or any part.
